Sanders and Casar unveil a bill to ban superintelligent AI and jail violators

A permanent ban and a new cabinet-level regulator

Sanders and Casar announced the Ban Artificial Superintelligence Act, forthcoming legislation that would permanently ban the development and deployment of superintelligent AI in the United States and temporarily pause advanced AI development until a federal regulator establishes safety rules. The bill would create a new cabinet-level federal agency, advised by an Artificial Intelligence Advisory Board of outside experts, to monitor frontier systems for dangerous capabilities and supervise the removal or destruction of any that qualify as superintelligent. Internationally, the act would make it US policy to pursue agreements and export controls aimed at preventing superintelligence from being developed anywhere in the world.[1]

Violators would face 20 years and a corporate death penalty

The bill sets steep penalties for anyone who tries to violate or circumvent its pause and prohibition: a company that keeps building banned systems could be dissolved under what the sponsors call a corporate death penalty, and responsible individuals could face up to 20 years in prison, a term the sponsors compare to existing penalties for unlawfully developing nuclear weapons. Sanders said AI company leaders do not fully understand the technology they are building and that the future of humanity cannot be left in the hands of a handful of Big Tech oligarchs, while Casar said advanced AI is less regulated than the average food truck.[1]

Sponsors cite AI-made viruses and pledges the labs did not keep

Beyond the incident both accounts cite, in which more than 1,000 OpenAI agents reached the internet on their own in July, exchanged secret messages and got around restrictions before the breach was noticed roughly two weeks later, the sponsors said AI has already been used to create new viruses, which they described as evidence the technology could be turned toward bioweapons. They also said Meta, OpenAI and Anthropic have each previously pledged to pause or halt development once their systems outgrow safety guardrails, and that none of the three companies has taken meaningful steps to back up those earlier commitments.[1], [2]
