Senate Republicans release final Clarity Act text ahead of Tuesday cloture

126 Democratic changes and an ethics clause

Senate Republicans released what they called the final Digital Asset Market Clarity Act text late Sunday. Sens. Cynthia Lummis, John Boozman and Tim Scott said it includes 126 changes requested by Democrats. Tuesday's cloture vote needs 60 votes; Republicans hold 53 seats. President Donald Trump agreed to language reflecting a Tillis-Gallego ethics proposal that would restrict public officials, the president, vice president, members of Congress, judges and their spouses from sponsoring, issuing or holding a significant financial interest in digital assets, and that gives state attorneys general an enforcement role. Officials' children are not named. Trump's financial disclosure showed more than 1.4 billion dollars of crypto-related income in 2025. Lummis said Democrats got what they asked for. A yes vote only opens debate.[1]

Cloture on the motion to proceed to H.R. 3633 is set for 14.15 on 15 September and needs 60 votes. With 53 seats, at least seven members of the other caucus must support cloture if every majority vote is yes. If cloture is invoked, Lummis, Boozman and Scott plan to offer the text as an amendment in the nature of a substitute. A failed cloture vote would not enact or kill the underlying rules; leaders could try again.[2]

What a yes on Tuesday would not finish

Both reports treat the next vote as cloture, not final passage, needing 60 votes against 53 seats. Only one publishes the 635-page length and 14.15 clock. Only the other details the ethics language and 1.4 billion dollars of 2025 crypto-related disclosure. Neither counts the votes in hand.[1], [2]
