Federal law displaced Ohio’s document rule
US District Judge Solomon Oliver Jr temporarily blocked Ohio from requiring citizenship documents for voter registration at a motor vehicle bureau. Al Jazeera and the Associated Press reported that he found the requirement likely to conflict with the National Voter Registration Act. Oliver said federal law permits states to seek only the minimum information necessary for registration; Ohio’s demand for documents went beyond the signed citizenship attestation accepted through its other registration methods. The injunction took effect before the Oct. 5 registration deadline for the fall midterm elections.[1], [2]
The order widened access through motor vehicle offices
The Associated Press reported that Oliver also found Ohio had violated federal law by limiting motor-voter registration to applicants who successfully obtained a driver’s licence. His order requires officials to offer a voter registration form even when an applicant lacks enough paperwork to complete the licence process. It does not extend that offer to applicants who state that they are not US citizens. The Elias Law Group brought the case for the Ohio Alliance of Retired Americans and Red Wine & Blue. Al Jazeera reported that Red Wine & Blue welcomed the ruling as protection for eligible voters before the deadline.[2], [1]
Ohio will appeal the injunction
Ohio Secretary of State Frank LaRose said he disagreed with the ruling and would file an immediate appeal. He argued that the order forces motor vehicle offices to offer registration forms to applicants who cannot verify their citizenship. Al Jazeera reported that Ohio Republicans added the document rule in 2025 after unproven claims that noncitizens were voting.[2], [1]
