International Criminal Court clears Duterte to stand trial

The International Criminal Court made public its decision that Rodrigo Duterte is fit to stand trial. An independent medical panel found that the former Philippine president can understand the charges and assist his defence. Opening statements remain scheduled for November 30. The ruling concerns participation in proceedings, while the criminal allegations still await trial.

The court publishes its fitness ruling

The International Criminal Court found former Philippine president Rodrigo Roa Duterte fit to stand trial. The court made the decision public on October 8. Opening statements remain scheduled for November 30.[1], [2]

Trial Chamber III, the court division hearing his case, issued the ruling on September 28. An independent panel of medical experts unanimously found that Duterte could understand the charges, the purpose of proceedings and the consequences of entering a plea, broadly follow the evidence and instruct his lawyers.[1]

Medical monitoring continues during proceedings

The ruling concerns Duterte’s ability to participate in the case; the criminal allegations remain to be tried. A medical officer at the court’s Registry continues to monitor his condition and must immediately inform the Chamber of significant changes. Arrangements for individual sittings take the accused’s and witnesses’ circumstances into account.[1]

The case proceeds toward November’s opening statements

Duterte entered the court’s custody on March 12, 2025, and first appeared two days later. Confirmation-of-charges hearings took place from February 23 to 27. Three crimes-against-humanity charges were confirmed on April 23, and the case went to Trial Chamber III the next day. The court set the opening timetable on May 27.[1]
