The reach of the ruling

On Friday 31 July, Judge Paul A. Engelmayer of the Southern District of New York rejected the motion by Perplexity AI and SerpApi to dismiss on standing grounds. Reading the Digital Millennium Copyright Act's language broadly, the judge noted that any person injured may bring a civil action for such a violation, and held that the harm Reddit alleges falls within the statute's protective scope. The claims about circumvention of protections and the bulk removal of user content will go forward.[1]

Clearing a motion to dismiss is not a finding that the allegations are true. At this procedural stage the court assumes the allegations and looks only at whether the case may continue. Nothing has been determined about what Perplexity or SerpApi did, no protective measure has been found to have been circumvented, and there is no finding about which content reached where.[1]

The factual questions still ahead

The allegation in the ruling joins two separate facts: circumvention of a protective measure, and the bulk removal of user content. Which measure was at issue, how it was got around, and by whom, are what the case has yet to produce. The technical route to reaching content and the legal meaning of breaking an access control are not the same thing, and what separates them is documentary evidence showing how the requests were made.[1]

The broad reading given at this stage may also narrow later. Standing and the merits are assessed by different tests: the first asks whether the plaintiff suffered a harm the statute protects against, the second whether the defendant's conduct falls within the statute's definition. Friday's ruling read the first question broadly; it gave no indication on the second.[1]

What a remedy would settle

The outcomes available in this case are built on access. Damages or an injunction manage the dispute over how the content was obtained; they do not show which Reddit post entered which answer in a product. Tracing the source would require an evidentiary path showing, on the product side, which text came from which origin, and that is separate work from proving the circumvention claim.[1]

The observable signal is in the docket itself. If, by 31 December 2026, either party produces technical documentation showing how the requests were made, or the court rules on the merits, it will become visible how far the standing question read broadly in the Reddit ruling determines the outcome. Until those documents arrive, the file holds an allegation permitted to proceed rather than a proven act of circumvention.[1]
