X and SpaceXAI moved to drop Apple from their antitrust suit, with prejudice

Apple claims withdrawn in Fort Worth
Al Jazeera reports that in a Monday court filing, Elon Musk's X Corp and SpaceXAI moved to dismiss their antitrust claims against Apple. The lawsuit, filed in August 2025 in federal court in Fort Worth, Texas, accused Apple and OpenAI of making ChatGPT the only generative AI chatbot integrated into iPhone software, including Siri, Writing Tools and the camera. The companies said they would continue their claims against OpenAI. The filing gave no reason.[1]
With prejudice, if the judge agrees
9to5Mac quotes the motion: plaintiffs have resolved their claims against Apple and seek dismissal with prejudice under Rule 41(a)(2). Apple does not oppose. The same filing says they do not seek to dismiss claims against OpenAI Foundation, OpenAI L.L.C. or OpenAI OpCo. Dismissal with prejudice would bar bringing those Apple claims again. Judge Mark Pittman still has to approve; 9to5Mac notes the dismissal is not final yet.[2]
OpenAI remains in the case
Both reports leave OpenAI as a defendant. Al Jazeera says X and SpaceXAI, which develops Grok, argued the Apple arrangement shut rivals out of prompts through Siri and related tools. 9to5Mac adds that the case had already moved into discovery, including a fight over Musk emails. Neither outlet publishes settlement payments or a revised distribution agreement.[1], [2]
