Bangladesh court leaves the central-bank governor change in force

High Court rejects the petition
Bangladesh's High Court summarily rejected a petition on 6 September that challenged Ahsan H Mansur's removal as Bangladesh Bank governor and Md Mostaqur Rahman's appointment in his place. The decision by Justices Khizir Ahmed Choudhury and AF Saiful Karim left the government's 25 February replacement in force. Deputy Attorney General Mahfuz Bin Yousuf said the court relied on the removal provision in the appointment contract.[1], [2]
Challenge targeted both decisions
The public-interest petition filed by lawyer Abdullah Al Mamun on 5 March asked the court to declare both the termination of Mansur's tenure and Mostaqur's appointment unlawful. It also sought a stay of the two gazette notices issued on 25 February. The petitioner's lawyers argued that the removal violated the incapacity condition in the Bangladesh Bank Order of 1972.[2], [3]
An appeal is planned
Abdullah Al Mamun said he would apply to the High Court's Appellate Division after receiving the written order. Mansur was appointed in August 2024 under a contract due to expire in August 2028. Alongside the notice cancelling the remainder of that tenure, the government issued a separate notice appointing Mostaqur for 4 years. The lower court's rejection left that appointment valid, and the stated next legal step depends on receipt of the written decision.[1], [3]
